What do offshore and onshore actually mean?

In broker marketing, offshore usually describes a firm incorporated or regulated outside the customer’s home market or a major financial centre. But the term is not a formal universal regulator category. A customer in one country may be “offshore” to a firm that is locally regulated for another customer.

Focus on whether the broker is authorised to offer the relevant product to you, and whether its oversight and investor-rights framework align with your needs. Geography alone does not prove a company legitimate or illegitimate.

Find the entity named in the signed client agreement. Then locate it in the official register of its stated regulator and review permissions. A European subsidiary’s regulatory badge is not a substitute for evidence that an international affiliate is licensed or supervised under the same rules.

Why higher leverage is not a reliable quality signal

Some jurisdictions restrict leverage offered to retail CFD customers. UK FCA rules for covered retail CFD products include leverage limits, margin close-out requirements and negative balance protection. These are investor-protection measures, not evidence that higher leverage elsewhere is inherently superior. See the FCA’s product intervention policy.

Leverage affects required margin and the pace of gains or losses, not the quality of the broker’s custody practices. An account with extremely high leverage can expose a smaller deposit to large notional positions; smaller margin is not necessarily smaller financial risk.

Investor compensation and complaints are different from leverage rules

Eligibility for compensation arrangements, external dispute resolution and consumer protection depends on jurisdiction, the type of firm, account classification and sometimes product type. Never assume that a compensation scheme is available to an offshore entity because another group company is authorised in a different country.

The FCA Firm Checker cautions that authorisation does not itself confirm whether compensation or ombudsman protection applies to an individual case. Verify these rights separately with the relevant scheme.

A practical two-layer risk review

Assess both the legal framework and the broker’s operating evidence
Layer 1 — Legal safeguards

Entity · permissions · rules · complaint rights · client-funds disclosures

Layer 2 — Service evidence

Execution quality · fee transparency · withdrawal terms · operational consistency

A positive score in one layer does not replace checking the other.

Claims such as segregated accounts, audited finances or guaranteed withdrawals should be checked against current disclosures and qualified independent evidence, rather than taken from an affiliate landing page at face value.

What should a cross-border trader do before depositing?

  1. Record the full legal name, country and jurisdiction in your contract.
  2. Check regulator status directly, including permitted services and restrictions.
  3. Read client-money and negative balance protection terms for your actual account.
  4. Verify withdrawal conditions, payment routes and applicable fees.
  5. Compare costs and trading conditions using a consistent scenario.
  6. Keep copies of the contract, policy documents and latest confirmation from the regulator.

Frequently Asked Questions

Is an offshore forex broker automatically unregulated?

No. The term is informal; you need to identify the actual regulator, legal entity, permissions and the law governing the account.

Does an FCA-licensed parent cover every overseas affiliate?

No. A group’s overseas subsidiaries may serve clients under separate agreements and frameworks. Verify the exact contracting firm.

Is very high leverage a benefit?

It reduces initial margin relative to exposure but can amplify losses. It is not evidence of reliability or investor protection.
